Judge denies bond for Tex McIver after murder conviction overturned – WSB-TV Channel 2

ATLANTA — A Fulton County decide has denied bond for a well known metro Atlanta lawyer whose conviction in his spouse’s homicide was overturned.

Claud Lee “Tex” McIver III appeared for a bond listening to Friday morning the place Choose Robert McBurney dominated towards his launch on bond.

McBurney mentioned he had issues about McIver posing a flight threat if the case is re-tried.

In 2018, McIver was convicted of felony homicide and possession of a firearm throughout the fee of a felony within the capturing demise of his spouse, Diane McIver.

The couple was on their approach house from a celebration with a pal in 2016 when McIver allegedly shot his spouse via the again seat of their SUV. She was rushed to the hospital, the place she died.

In June, the Georgia Supreme Courtroom overturned McIver’s homicide conviction.

McIver was tried and sentenced to serve life in jail for felony homicide, 5 concurrent years for influencing a witness and 5 concurrent years suspended for the gun crime.

The jury acquitted McIver of malice homicide, a cost that suggests the homicide was deliberate.

The Georgia Supreme Courtroom reversed McIver’s convictions as a result of the trial courtroom “erred in denying his request to cost the jury on a lesser involuntary manslaughter offense.”

After the courtroom’s resolution was made, Fulton County District Lawyer Fani Willis submitted a movement in July to retry McIver.
